These Terms and Conditions govern your use of the Bhimala Estates website and all services we provide. By accessing our website or engaging our services in any way, you agree to be bound by these terms. Please read them carefully.
Bhimala Estates is a digital marketing agency specialising in Dubai real estate. We promote property listings across digital platforms on behalf of RERA-licensed agents and connect property seekers with verified agents through our marketing channels.
Bhimala Estates is not a real estate brokerage. We do not directly facilitate, negotiate, or execute property transactions. All transactions are conducted solely between the client and the relevant RERA-licensed agent. The agent remains solely responsible for all regulatory compliance under UAE law and RERA regulations.
Our services are divided into two categories:
— Property Seekers: individuals looking to rent or purchase property in Dubai
— Agent Partners: RERA-licensed real estate agents and agencies partnering with us for digital marketing services
2.1 OUR SERVICE TO YOU
Bhimala Estates provides property matching and personal guidance to property seekers at zero cost. We do not charge buyers, renters, or property seekers any fee at any stage. Our income is derived solely from Performance Share fees paid by agent partners upon successful deal completion.
2.2 NATURE OF OUR ROLE
We are an intermediary and guide. We are not a party to any rental or sale agreement between you and an agent or landlord. We do not hold or manage any funds. All contractual commitments are made directly between you and the relevant agent or landlord.
2.3 PROPERTY LISTINGS
Every listing on Bhimala Estates is verified before publication and reconfirmed available every 30 days. However, property availability can change rapidly and we cannot guarantee any specific listing remains available at the time of your enquiry. Property details including price, size, and features are provided by agent partners. While we review all submissions, we are not liable for inaccuracies in agent-supplied information.
2.4 YOUR RESPONSIBILITIES
You agree to provide accurate information about your requirements and identity when engaging our services. You agree to conduct your own due diligence before committing to any property agreement. You agree not to attempt to bypass Bhimala Estates and contact agents directly in a way designed to circumvent our marketing arrangement, where an introduction has been made through our platform.
3.1 ELIGIBILITY
Partnership is available exclusively to individuals and agencies holding a valid, current RERA license issued by the Real Estate Regulatory Agency of Dubai. Partners whose RERA license lapses must notify Bhimala Estates within 48 hours. Failure to do so constitutes a material breach.
3.2 THE PARTNER AGREEMENT
All agent partners must sign the Bhimala Estates Digital Marketing Partner Agreement before any listings are published or client introductions are made. The Agreement is executed digitally and is legally binding under UAE Federal Decree-Law No. 46 of 2021 on Electronic Transactions.
3.3 PERFORMANCE SHARE
Our digital marketing Performance Share is 50% of the agent's earned commission on any deal successfully completed with a client introduced through Bhimala Estates. This is payable within 7 days of deal completion. The Performance Share applies to any deal completed within 12 months of the documented introduction date.
3.4 AGENT OBLIGATIONS
Agents must handle all introduced clients professionally and honestly. Agents must reconfirm listing availability every 30 days. Agents must notify Bhimala Estates within 48 hours of any deal completion with an introduced client. Agents must provide valid property documentation for every listing submitted.
All content on the Bhimala Estates website — including the name, logo, symbol, the Bhimala Verified mark, taglines, design elements, and written content — is the exclusive intellectual property of Bhimala Estates. You may not reproduce, copy, or use any of our brand assets without prior written permission.
Agent partners grant Bhimala Estates a non-exclusive licence to use submitted property photographs and listing content for marketing purposes during the listing period.
To the fullest extent permitted by applicable UAE law, Bhimala Estates is not liable for any loss arising from inaccurate property information provided by agent partners, any dispute between a property seeker and an agent, any transaction between a property seeker and an agent or landlord, or any technical failure or downtime of our website or digital systems.
Our total aggregate liability in connection with our services shall not exceed the Performance Share fees received from the relevant agent in the 12 months preceding the event giving rise to any claim.
Any dispute shall first be addressed through good faith direct negotiation. If unresolved within 30 days, the matter proceeds to mediation. These Terms are governed by the laws of the United Arab Emirates. Unresolved disputes are subject to the exclusive jurisdiction of the courts of Dubai.
We may update these Terms from time to time. We will update the effective date at the top of this page. Continued use of our website or services after any update constitutes acceptance of the revised terms.
